Under the Governor’s Executive Order issued today, the March 25th Order from Chief Judge Barbera, and the Coronavirus Aid Relief & Economic Security Act (C.A.R.E.S. Act)

  • NO EVICTION for residential and commercial tenants who suffered a substantial loss of income due to COVID-19 or related closures. *However landlords may continue to file failure to pay rent cases. The cases will be held until the state of emergency is over. (Tenants will not be evicted during the state of ER). *EXCEPT for tenants in HUD (HACA/HCAA) there is a 120-day period where no court cases can be filed for failure to pay rent, and no late fees can be charged.
  • NO FORECLOSURE no new foreclosure actions can be filed and all pending foreclosure actions are suspended
  • NO REPOSSESSION of mobile homes, trailers, live-aboard boats, or automobiles

*The Governor’s Executive order expressly states that it does not relieve any obligation to pay rent or mortgage. It simply prevents eviction, foreclosure and repossession.
